Legal Music Download Vs File-sharing

Consumer attitudes towards music downloads have changed dramatically. Legal music downloads have increased by almost 30% whilst illegal downloads have seen a decline of the same amount. Why the change ? Research in Austria suggests that consumers fear legal action against file-sharing (illegal music downloads).Not only are you breaking the law by downloading copyrighted material, but you are also downloading potentially harmful viruses to your PC. Close to 40% of file-sharers in the US and the UK have cited that the main reason they stopped downloading music using P2P (peer-to-peer) programs such as Kazaa was due to the fear of lawsuits. Since the recording industry started taking legal action against file-sharers in September of 2003, 14227 actions have been announced in 12 countries. These lawsuits can cost you tens of thousands of dollars !

It isn’t your average teenager who downloads music illegally on the internet. You’d be surprised to learn that people from all walks of life are involved too. Doctors, teachers, nurses, cooks, university students, and even a judge ! John Kennedy, IFPI (International Federation of Phonogram and Videogram Producers) Chairman and CEO, had this to say, “We are now seeing real evidence that people are increasingly put off by illegal file-sharing and turning to legal ways of enjoying music online. Whether it’s fear of getting caught breaking the law, or the realisation that many networks could damage your home PC, attitudes are changing, and that is good news for the whole music industry.”

Legal music downloading started really taking off during the first half of 2005, especially in Europe. In the US alone, 159 million tracks were legally downloaded in that period. Subscriptions to online music downloading services such as Napster, iTunes and Rhapsody now count well over 3 million users. Napster, for example, is expanding its reach. There is Napster UK, Napster Germany and Napster Canada. Hopefully they will expand into countries like Australia, France, South Africa and many more.

Connect by Sony, Real’s Rhapsody, and Apple’s iTunes are three of the most popular legal downloading services. You can expect to get charged between 79¢ and 99¢ per song. The monthly subscription charges range between $10 and $15. What would you rather pay ? $15 per month or $15,000 in court fees ?

File-sharing networks are plentiful on the internet, with Kazaa being one of the most popular. Yes, the music is free, but you are better off paying the price of a CD per month and getting your music legally.

Rather than arguing that accused file-swapper Joel Tenenbaum failed to do it, Nesson is saying that Nesson did nothing wrong because sharing files with your “friends” over the web isn’t essentially a crime, and is covered under well-established Fair Use laws. Additionally , according to Nesson, the aggrieved party in a file-copying case isn’t entitled to any damages anyway.

Nesson’s methodology is incredibly bold — should he achieve success in this novel defense, it will, basically, de-criminalize P2P file-sharing forever.

There are ways to get away with free music downloading. Many people assume that Napster failed just because of the free music, but that’s not the whole story. The truth is people were trading entire cd’s and not just a few songs here and there. That is what got the attention of the media and of lawyers who sued.

Each song that you have on your computer individually is a file. When you go to download sites you are file swapping. This is free of charge and not considered illegal. Maybe just a little dishonest.

File swapping is where two people can exchange songs that at some point had to be purchased by some person. If only one person purchases the song or cd, then it is ok for them to share the file with as many people as they like, because the record company got its cut.

When downloading you may have to download a song a few times before you get a good copy. Sometimes you are just getting a sample. It’s a trick to get you agitated and try to make you go buy the whole cd when you just want that one song. Just keep trying, you will find the song eventually. Remember nothing is free and you may have to put in a little more effort to get what you want.

Don’t bother with sites that want you to fill out a bunch of personal information to get a free download. When you are accepting their terms that you know you never bother reading it says that they can sell your information. If the site is asking for a lot of personal information just move on. There are other sites out there available to you that will not violate your privacy for a free download.

Music – there can be said so many things about it, but there’s so little time to do it. After all, one could write a “Music Bible,” and there still would be enough room for at least another dozen of similar books. Music brings people together, but also can start wars, but most interesting thing about music, these days, is how people reach it, and the real value music has. Why, that’s what I’ll tell you next, because I always thought that behind the innocent “free & legal music downloads” phrase there’s hiding something really evil…

When talking about recorded music, I think first way of recording music was to write down the notes for others to play it. Unfortunately, not everyone is a musician. Fortunately for most skilled musicians, playing well saved their lives in some situations(just think about cities conquered, and population slaughtered… with a few exceptions, including those who sang well enough to please the conquerors, and lucky enough to prove it before being killed without any questions).

As mankind entered the Industrial Era, recording sound became easier as time passed, but only in the last few decades music turned into something produced for (and consumed by – obviously) the masses. Before moving on to tackle the free, legal music downloads that are considered a real plague by some of those in the music industry(and by myself, but for different reasons), I must get a little personal…

… with some of my memories regarding music – how it was, and how it became. Back in my teenage years, grabbing a tape from the music store or – when I was lucky to have the money – a CD, was a real celebration. Needless to say how proud I was to find some rare vinyl recording, and how many times those tapes and CDs were played. Most of them are still around, and I get back to them everytime I want to summon pleasant memories. Back then, I treated music as a gift, and as something you don’t cross your path with every minute.

Now? Well, usually I am not looking for free, legal music downloads, simply because I still enjoy having the CD in my hands, so I end up buying my music on CD/DVD. I don’t have to go out of the house, I don’t have any occasion to go to the music store and have a chat with that old hippie selling CDs, simply because the store is gone. All I have to do is type in some address in my Web browser, pay using my credit card or PayPal, and then wait for the package. Sometimes, I even download promo tracks from the artist’s website, if I am really that anxious to hear as much as possible before having the real thing in my hands.

Is this good? Is this bad? Free or paid, legal music downloads will never beat the real thing, at least for some of the music consumers. I hope we’re not only a few chosen ones, because some things should remain unchanged, and the way we enjoy music should never turn into clicking through some websites and loading our portable media player with tracks.

While the real history of the iPod may shadow a less known history, that of turning music from art into a cheap product for the masses, in most cases, I think free music downloads or paid ones should survive, but people and advertisers should also keep in mind that the real thing is always better than the virtual one and act accordingly.

I’m sure that you have run into “torrents” this is basically a fancy word for either virus infected trash…or hey music companies please sue me next for downloading your music illegally. These torrent files are notorious for being infected with just about any type of malicious code that can be found online. Once you download the file and try to open it there is often a message telling you to go to a website to get a password, code, or to download some type of “special software” that will allow you to open the file and transfer the music to your ipod. Guess what happens next? Yup…you now have a virus on your computer but, even more frustrating is the fact that your pod is still empty.

You will also find sites that charge you a monthly fee. You are charged weather you choose to use their service or not. Basically, you are going to pay about $240.00 dollars or more which to me is completely unacceptable. You will also find the companies that want to charge you individually for every file that you download. If this is the route you decide to go I would highly suggest that you just go to itunes.com. They are EXPENSIVE but if you are going to pay that kind of loot you might as well use a reputable company.

The absolute best option is to join a community of other ipod users that are also in search of all of the media they can scarf up to load their new toy with as many ipod songs, ipod films, and ipod software possible. Often, these sites will charge a nominal ONE TIME fee for you to become a member. Once you join you will be able to get your hands on virtually anything that you would/could ever want for your ipod.

I have already mentioned that an ipod is an extremely large investment for many of us. This is especially true if you are like everyone else who is scraping and fighting for every dollar you have. At the end of the day totally free ipod downloads are not available however, there are sites that will allow you to download as many files you want for a couple of bucks.

That’s not to say that music downloads are a threat to the music industry – far from it.
